Damage and Financial Responsibility Agreement

This Damage and Financial Responsibility Agreement ("Liability Form") is between Sandbridge Carts ("Company") and the Renter ("Renter") for reservation (your reservation), covering the rental week of (check-in date) through (check-out date) and cart number(s) (assigned at delivery).

1. Responsibility for the cart

From delivery until the Company picks up the cart, Renter is responsible for the cart, its key, charger and all equipment. Renter is financially responsible for any damage, loss, theft or vandalism that happens during that time, unless the damage was caused by a defect in the cart or by the Company.

2. What Renter will pay

If a cart is damaged, lost or stolen during the rental week, Renter agrees to pay:

  1. The reasonable cost to repair the cart. If the cart cannot be repaired, or if the cart is lost or stolen and not recovered, Renter agrees to pay its fair market value at the time of loss.
  2. Loss of use at the cart's weekly rental rate, pro-rated by day, for the time the cart is out of service for repair, up to 4 weeks.
  3. Towing, recovery, storage and impound charges.
  4. The cost of any missing or damaged key, charger or equipment.

The Company will give Renter a written, itemized statement of charges, with photos or repair estimates, and Renter agrees to pay within 14 days of receiving it.

3. Accidents involving others

Renter is responsible for injury to other people and damage to other property caused by Renter, any driver, or any passenger while using a cart, to the extent permitted by law. Renter agrees to indemnify the Company, meaning Renter will cover the Company's costs, for claims made against the Company because of that use. This does not apply to claims caused by the Company's own negligence, gross negligence or willful misconduct.

4. Insurance

Renter understands that the Company does not provide Renter with collision or damage coverage for the cart. Renter's personal auto, homeowner's, renter's or credit card insurance may or may not cover a rented low-speed vehicle, and Renter is responsible for checking with their own insurer.

5. Reporting

Renter must report any accident, damage, injury, theft or loss to the Company at (757) 650-4590 within 1 hour, and report any theft or accident involving another vehicle, person or property to police. Renter will cooperate with the Company and its insurer in any investigation.

6. Personal property

The Company is not responsible for personal items left in or on a cart, or lost or damaged during the rental.

7. General terms

This Liability Form is part of the Rental Agreement for this reservation and is governed by the laws of the Commonwealth of Virginia. If any part is found unenforceable, the rest remains in effect. Renter agrees to sign this Liability Form electronically, and that the electronic signature below has the same effect as a handwritten signature.

By signing, Renter confirms that they have read and understand this Liability Form and accept financial responsibility as described above.
