Liability Waiver, Assumption of Risk and Release

Each person who will drive a Sandbridge Carts golf cart must read and sign this waiver before delivery. In this waiver, "Company" means Sandbridge Carts and its owners, employees and agents.

1. Driver statements

I confirm that:

1. I am 21 years of age or older and hold a valid, unexpired driver's license, and the license information and photo I provided are accurate.
2. I am physically and mentally able to drive the cart safely, and I will not drive while impaired by alcohol, marijuana, drugs, medication or fatigue.
3. I have read the Rental Agreement rules of use, and I will follow them and all traffic laws.

2. Risks I understand

I understand that driving and riding in a golf cart or low-speed vehicle on public roads involves risks, including:

• Collisions with cars, trucks, bicycles, pedestrians, animals or fixed objects.
• Tipping or rolling over, especially on turns, slopes, curbs or loose sand.
• Being thrown from the cart. The cart does not offer the crash protection of a car.
• Weather, wet or sandy roads, low light and the actions of other drivers.
• Injury to passengers, including children, who do not stay seated.

These risks can cause property damage, serious injury or death. I voluntarily accept these risks for myself and I am responsible for driving in a way that keeps my passengers and others safe.

3. Passengers

I will not carry more than 6 people, I will make sure every passenger stays seated, and I will follow Virginia child-restraint laws. I will not let anyone else drive unless they are an authorized driver who has signed this waiver.

4. Release

To the fullest extent permitted by Virginia law, I release the Company from claims for property damage, loss or expense that arise from my use of the cart, except claims caused by the Company's gross negligence or willful misconduct. I understand that this release may not apply to every claim for personal injury under Virginia law, and that the remaining parts of this waiver still apply.

5. Responsibility for my actions

To the extent permitted by law, I agree to indemnify the Company, meaning I will cover the Company's costs, for claims by my passengers or other people that are caused by my own negligent or unlawful driving.

6. Medical treatment

If I am injured and unable to consent, I authorize emergency medical treatment, and I am responsible for its cost.

7. General terms

This waiver is governed by the laws of the Commonwealth of Virginia. If any part is found unenforceable, the rest remains in effect. I agree to sign this waiver electronically, and that my electronic signature below has the same effect as a handwritten signature.

I have read this waiver, understand that I am accepting risks and giving up certain rights, and I am signing it voluntarily.
